Written complaint of ATO combatant made physicians more careful

The medico-social commission granted the seriously wounded ATO combatant only 25% disability. Respectively, he was awarded too low amount of social payment. The soldier considered such decision unfair, filed a letter of complaint with the lawyers’ help and achieved revision of the decision of the commission.

In October, 2015 the ATO combatant Ivan Korotysh* addressed Bilotserkovsky Law Community Center at the city public organization "Legal Unity".

Ivan told that he had had examination in Beiotserkovsky interdistrict medico-social expert commission (IMSEC) to identify a disability level. For this purpose he collected all necessary papers, received medical certificates and results of analyses and passed the military-medical commission. The diagnosis was the following: consequences of the gunshot perforating wound with injury of both lungs.

However, Ivan claimed that during the examination doctors of MSEC had not study materials of medical case comprehensively, fully and objectively, ignored oral explanations. As a result they made the biased decision: since August 20, 2015 the soldier lost only 25% of pre-injury capacity.

Ivan disagreed with such decision and addressed the Center. The lawyer Marina Lysych helped him draw up a letter of complaint to Kyiv regional MSEK with a request to carry out inspection, to revise the decision and to establish the relevant disability level. The copy of the letter was sent to the Health Care Department of Kyiv Regional State Administration so that experts could check quality of the work of the regional MSEC.

“Soon the man came to the Center with good news: Kyiv regional MSEC increased disability percent from 25% to 40%. Thus, the sum of payment increased approximately by 13 000 UAH”, the lawyer explained.

The name is changed due to ethical reasons.
