Human rights activists proved that soldier posthumously awarded with Order For Courage was ATO combatant

The father of the lost ATO combatant addressed Chuhuiv human rights group with a request to help establish the fact of his son’s participation in military operations when being in ATO zone, and also the fact of his death during combats in the temporarily occupied territory when performing a combat mission.

The father of the dead needed the official confirmation of the fact to receive guarantees on protection of social, property and other civil rights, namely to identify members of the family of the lost, that is persons who are applied the Law of Ukraine "About the status of veterans of war, a guarantee of their social protection".

According to the Decree of the President of Ukraine No. 873/2014 of 14.11.2014 "For the personal courage and heroism shown in protection of the state sovereignty and territorial integrity of Ukraine, fidelity to the military oath" the lost guy was awarded the Order "For Courage" of the ІІІ degree (posthumously).

Therefore, there was an absurd legal situation: the dead was posthumously awarded the Order for protection of the state sovereignty and territorial integrity of Ukraine, however, due to the lack of number of papers he was not recognized as the ATO combatant who was lost when performing his military duty.

Human rights activists filed the statement of claim against the Department of labor and social protection of the population, the General Directorate of Ministry of Internal Affairs of Ukraine in Kharkiv region (the courageous defender of Homeland served in the special battalion) and State Service of Ukraine for war veterans and ATO participants.

The claim was satisfied. Special gratitude should be expressed to the representatives of the defendants who did not object to satisfaction of the claim, in every possible way supported the father of the lost soldier and submitted all necessary papers not to drag out trial.
