Turning to the Novoaydar office of the Legal Development Network a resident of the Luhansk region got not only detailed advice but also assistance in the preparation of documents.
In July Galina Ivanchuk* inherited 2 land plots from her mother, which during the life the mother leased to the local farming company.
Having received the land, Galina repeatedly requested the tenant to provide the contract settlement, but was rejected.
In search of effective solution of the problem the woman addressed Luhansk NGO “Public Legal Aid”.
After analyzing the situation, the lawyer Tatiana Ganshyna recommended to submit the written statement to the tenant with a proposal to conduct the calculation on the basis of certificates of inheritance, because in case of conflict the women should have the documents to confirm the tenant fails to fulfill the duties.
The lawyer also told her that although she had received 2 certificates of inheritance for each plot separately, but she had the property right only for 1 plot. But her mother signed the lease over all the land.
"According to article 125 of the Land Code of Ukraine the right to the ownership of the land arises from the moment of the state registration of the right", explained Tatiana Ganshyna.
So the woman was advised to issue the property right for the second plot.
