Alimony in marriage: to pay or not?

Lawyers of Khmelnytskyi regional public organization "Podil Legal League" helped in the recovery of alimony from an unscrupulous father. It prevented the marriage from dissolving.

In March a young mother Maria Gordienko* addressed Khmelnytskyi office of Legal Development Network, who on her own brings up a two year old son. Because all the time the woman is engaged in taking caring for the child, she can’t work and is only helped by her parents. Although Maria is married, the husband does not support the family giving money for neither drugs nor clothes for the son. The woman was sure that in order to receive the child support, she first had to terminate the marriage.

"Regardless of the terminated marriage or not, according to article 180 of the Family Code of Ukraine, parents are obligated to support the child to adulthood", explained the lawyer of the Center Anastasia Ploshchynska.

The lawyer advised Mrs. Gordienko to apply to the court for alimony and helped the woman make a claim.

Due to the prompt and quality work of Anastasia Ploshchynska in August the court ruled in favor of Maria, obliging the father, starting from March 2016 until the son comes of age, to pay 650 UAH per month for his maintenance.

The lawyers of the Podil Legal League remind: in order to collect child support you need not terminate the marriage. If one of the spouses does not fulfill the obligation to maintain the child voluntarily, in accordance with articles 181-184 of the Family Code of Ukraine you can get him/her to do it through the court.
