Do not let the Pension Fund “fool” you

A woman from Kherson had to turn to Court to raise her pension payments by 100 hryvnas. She managed to do it with the help of Kherson Community Law Center.

100 hryvnas is not that much (15 US dollars). But for an old woman from Kherson it means a lot. Every month she has not been receiving her full pension payment. And in a year it has become quite a sum of money. This is what happened to Nina Kondratenko: she has lost money because of the unlawful decision of representatives of the Pension Fund.

Nina Kondratenko has been working for the State for 38 years and in 1992 she retired. In 2010 her husband tragically died. According to the law, Nina should now receive not the ordinary retirement pension but a specific pension for widows. In 2012 she turned to the local department of the Pension Fund of Ukraine and registered her new status. However, the workers of the Pension Fund did not take into account the new regulation that raised the pension by 100 hryvnas. They ignored the ministerial decree #327 and for some reason decided that the raise is not applicable in case of change of pensions. Nina was outraged by this and turned to Kherson Community Law Center for help. Oleksandr Tokalenko, the Center’s lawyer explained what she had to do and prepared an administrative complaint against the local department of the Pension Fund.

During the Court hearing, the representatives of the Pension Fund could not clearly argue their position and refused to explain why they have cut short Nina’s pension. The Court ruled in favor of the complainer. Odessa Court of Appeal received a complaint of the Pension Fund but kept the Kherson Court decision in force.

Nina Kondratenko, thanks to her determination and with the help of Community Law Center, is now receiving her full pension.
