Another fiasco of executive bodies of Rivne

A woman from Rivne won her case in the regional Court of Appeal against a representative of the State executive service, responsible for the realization of Court decisions. She had to address the Court of Appeal as Rivne Municipal Court ruled against her.

She turned to Rivne Community Law Center in January 2013. She explained that the local State executive service is taking too long to enforce Court decisions. She named the representative of the State executive service who closed her case without proper enforcement.

Lawyers of Rivne Community Law Center helped her and prepared a complaint against the State executive service. However, Rivne Municipal Court refused to rule on this case. After a few months and several complaints, the Court of Appeal forced the Municipal Court to take this case. But it was not over. In August, Rivne Municipal Court ruled against the client of Community Law Center. This was unusual. Mykola Glotov, Head of Rivne regional Committee of voters of Ukraine, explained that they have received a lot of citizens who complained against the State executive service. This service was not working properly and people were dissatisfied with them. Usually, local Courts rule in favor of people and there are quite a lot of successful cases in Rivne and in neighboring Radyvylov. But in this case, that was similar to others, the Court for some reason ruled against the complainer. Rivne Community Law Center helped her to prepare yet another complaint to the Court of Appeal.

Recently, the Court of Appeal took the final decision and ruled in favor of the complainer. The decision of Rivne Municipal Court was canceled. Moreover, the Court of Appeal also canceled the unlawful closure of the case by the State executive service. The judge explained that if the State had to pay this woman money, lack of local funds is not a reason to close her case. The State executive service has to look for different ways to reimburse her. According to the Law, the State executive service has three days to reopen the case and start the enforcement of the Court decision.
