The author of the claim against the Cabinet, Senior lecturer in programming of LNU Svyatoslav Litynsky
A senior lecturer in programming at Ivan Franko National University in Lviv won a victory in court, the decision of which obliged the Cabinet to raise salaries of teachers, doctors, teachers... up to 22%! This is reported by Lviv portal with reference to Svyatoslav Litynsky’s claim against the Cabinet.
"District administrative court of Kyiv declared the paragraphs 1 and 2 of the Resolution of the Cabinet of Ministers of Ukraine "About increase of payment of workers of establishments, institutions and organizations of separate industries of the budget sphere" № 731 of September 16, 2015 illegal.
The salary of majority of public sector employees is calculated based on the size of an official salary (the tariff rate) of employees of the 1st tariff category. According to article 6 of the Law of Ukraine "On remuneration of labour" and article 96 of the Code of labor Laws of Ukraine, this rate should exceed the statutory minimum wage. However, on September 16 last year the government adopts the Resolution according to which it pays salaries to state employees, based on obscure figures of 1012 UAH.
Let’s calculate my salary as a senior lecturer at Lviv National University. The rate of the first category worker (a minimum of 0.01 UAH +1378 UAH of minimum wage as of September 1, 2015) is multiplied by coefficient 3, which corresponds to my category of tariff (17). Therefore, the size of my salary should be 4 134.03 UAH, but not 3 036 UAH, as I am paid thanks to the Cabinet.
Note that these figures were accurate at the time of filing a claim. As on May 1 the amount of minimum wage was increased, the figures are higher now", he said.
He also told that he had decided to defend his rights in court – with the support of the Ukrainian centre for socio-legal studies. And now this ruling should raise the public sector wages by at least 22%.
"This is not a special case, this applies to all. The Cabinet is now obliged to set the size of the official salary of worker of first tariff category at a level higher than the minimum wage," he added.
It is worth mentioning that previously it was Svyatoslav Litynsky who won in court the passport without the page in Russian. It is the Ukraine's first passport completed only in the state language that was issued in August 2015. He then won a court case against Avakov. In particular, the activist demanded of the Ukrainian translation of the speech of the Minister of Internal Affairs Arsen Avakov, who spoke Russian. After that the Ministry of Internal Affairs of Ukraine translates all video speeches into the state language. In addition, he won a number of lawsuits against brands for marking products for Ukrainians in Ukraine.
