Ukrainian children got the opportunity to send to the UN Committee on the rights of the child complaints of grave or systematic violations by a state of rights under the Convention on the rights of the child or the optional protocols thereto, if the national protection have been exhausted, according to LEAGUE LAW.
The Committee will consider complaints on the sale of children, child prostitution and child pornography, on the involvement of children in armed conflict, and may ask the state to take interim measures to protect the child or group of children.
If it is determined that the state violated the Convention, the Committee will formulate specific recommendations that the state should run.
The optional Protocol to the Convention on the rights of the child entered into force for Ukraine oj December 2, 2016, stated in the letter of the Ministry of Foreign Affairs of Ukraine dated 03.01.2017, p. No. 74/14-612/1-7.
The optional Protocol was ratified on 16 March 2016 by the Verkhovna Rada of Ukraine, with the proviso that during the period of temporary occupation of Crimea and till the full restoration of constitutional order and the effective control of Ukraine on the occupied territory and in certain districts of Donetsk and Luhansk regions, applications and/or implementation by Ukraine of obligations under the optional Protocol in these territories is limited and not guaranteed.
